1. Alleged violations are judged by a standard of a “fair preponderance of the evidence”- not a standard of “guilty beyond a reasonable doubt.” In other words, people are found in violation if it is more likely than not that they committed the violation.
2. As long as you are a Wesleyan Student, the Code applies to you all the time, not just when you are on campus. Wesleyan students can be held accountable to the Code of Non-Academic Conduct and brought before the SJB no matter where the alleged violation took place. More specifically, the regulations apply even to people living in residences off campus.
3. The SJB employs progressive sanctioning. Sanctions for the same type of violation became harsher for repeat offenses.
4. People who come before the SJB are entitled to have the assistance of a Process Advisor if they so choose. Process Advisors can help explain the regulations that allegedly were violated, as well as the procedure of the hearing. They are also entitled to be present at the hearing. There is a list of people who have volunteered to be Process Advisors at http://www.wesleyan.edu/studentservices/sjb/sjbadvisors.html (all RAs are Process Advisors)
5. SJB decisions as to whether an individual was in violation or not are final. They cannot be overturned by the deans. They can be overturned only by the President through an appeal process that requires very specific grounds (e.g. improper procedure).
A Few Words About the Board Itself:
The current SJB includes members of Greek organizations, athletic teams, Pangea, the WSA, the debate team as well RAs and students of color.
In the last 5 years:
33% of the Board members have been athletes
17% were members of Greek organizations
50% were students of color.
